    Terms and conditions

    These terms and conditions govern the relationship between Chrisp Design ("we", "us", "our") and any client ("you", "your") who engages our services. By signing a proposal or contract with Chrisp Design, you agree to these terms in full.


    1. About us

    Chrisp Design is a UK-based web design, AI automation, and digital marketing agency. We operate under the trading name Chrisp Design and can be contacted at info@chrispdesign.com.


    2. Our services

    Chrisp Design provides the following services, as agreed in your signed proposal:

    • Website design and development
    • AI systems and automation
    • CRM setup and management
    • Missed call text back and all-in-one inbox systems
    • Local SEO
    • Google Business Profile optimisation
    • Google Ads and Meta Ads management
    • Email marketing and automation
    • Social media management
    • Booking systems and lead generation tools
    • Any other services outlined in your proposal

    The specific services, deliverables, timelines, and pricing applicable to your engagement are set out in your signed proposal. In the event of any conflict between these terms and your proposal, the proposal takes precedence.


    3. Proposals and agreements

    A contract is formed when you sign a proposal issued by Chrisp Design. By signing, you confirm you have read, understood, and agree to these terms and conditions in full.

    Proposals are valid for 14 days from the date of issue unless otherwise stated. We reserve the right to withdraw or amend a proposal if it has not been signed within this period.


    4. Payments

    Payment terms are set out in your signed proposal. Unless otherwise agreed:

    • Monthly service fees are billed in advance on a recurring basis
    • One-off project fees may require a deposit before work begins
    • Invoices are due within 7 days of issue
    • Late payments may result in work being paused until the outstanding balance is cleared

    We reserve the right to charge interest on overdue invoices in line with the Late Payment of Commercial Debts (Interest) Act 1998.

    All prices are exclusive of VAT unless stated otherwise. VAT will be added where applicable.


    5. Your responsibilities

    To allow us to deliver your services effectively, you agree to:

    • Provide all required access, content, assets, and information in a timely manner - including but not limited to domain access, Google accounts, logos, images, and business information
    • Respond to communications from our team within a reasonable timeframe, typically within 2 business days
    • Review and approve work within agreed timelines - delays caused by late approvals may affect delivery dates and do not constitute a failure on our part
    • Ensure all content and information provided to us is accurate, legal, and does not infringe any third-party rights
    • Use any systems, tools, or platforms we build or provide in line with the guidance given

    Delays caused by your failure to meet these responsibilities do not entitle you to a refund or extension of the guarantee period.


    6. Cancellation and notice periods

    Our services operate on a rolling monthly basis with no long-term contracts, unless otherwise stated in your proposal.

    You may cancel at any time by providing written notice to info@chrispdesign.com. Notice must be received before your next billing date to avoid being charged for the following month. Cancellation takes effect at the end of the current billing period.

    No refunds are issued for partial months unless covered by the 30-day guarantee outlined in Section 8.


    7. Ownership and intellectual property

    On receipt of full payment, ownership of the website design and content created specifically for you transfers to you. This excludes any third-party assets, licensed software, plugins, or platform components which remain subject to their own licensing terms.

    Any templates, frameworks, systems, or methodologies developed by Chrisp Design remain our intellectual property. We reserve the right to use work completed for you in our portfolio and marketing materials unless you request otherwise in writing.


    8. 30-day money back guarantee

    We stand behind the work we deliver. If you are not satisfied with the system we have built, you may request a refund within 30 days of the system going live, subject to the following conditions.

    To qualify for the guarantee

    • The website and all associated systems must have remained live and active throughout the 30-day period
    • All core components must have been used as intended and in line with the guidance provided
    • You must have responded to all enquiries generated within a reasonable timeframe
    • Where traffic is your responsibility, you must have actively driven traffic to the system during the period
    • No significant unauthorised changes must have been made to the website, automations, or booking flow

    What the guarantee covers

    The guarantee applies to enquiry generation. If the system has been implemented and used correctly and has generated zero enquiries in 30 days, you are entitled to a full refund.

    The guarantee does not cover subjective dissatisfaction with design, enquiries that were generated but not converted due to client handling, or situations where the system was not used as intended.

    How to claim

    Requests must be made in writing to info@chrispdesign.com within the 30-day window. We will review system data, usage, and activity before processing any refund. We reserve the right to attempt to resolve performance issues before issuing a refund. The guarantee may only be claimed once per engagement.


    9. Third-party platforms and services

    Many of our services rely on third-party platforms including but not limited to Google, Meta, GoHighLevel, domain providers, and hosting providers. We are not responsible for delays, outages, policy changes, or performance issues caused by these platforms.

    Any third-party costs - including ad spend, domain fees, or platform subscriptions - are separate to our fees and are your responsibility unless explicitly included in your proposal.


    10. Confidentiality

    Both parties agree to keep confidential any information that is clearly sensitive or has been shared in confidence. This includes business strategies, client data, pricing, and proprietary systems. This obligation continues after the end of our engagement.


    11. Data protection

    Chrisp Design processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Our full Privacy Policy is available at chrispdesign.com/privacy.

    Where we process personal data on your behalf as part of the services we provide, we act as a data processor and you act as the data controller. You are responsible for ensuring you have a lawful basis for sharing that data with us.


    12. Limitation of liability

    To the maximum extent permitted by law, Chrisp Design's total liability to you in connection with any engagement shall not exceed the total fees paid by you in the three months preceding the claim.

    We are not liable for any indirect, consequential, or special losses including but not limited to loss of revenue, loss of profit, loss of data, or loss of business opportunity.

    Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.


    13. Termination

    We reserve the right to terminate an engagement immediately if:

    • Payment remains outstanding after reasonable notice
    • You breach these terms and fail to remedy the breach within 7 days of being notified
    • Your conduct is abusive, threatening, or otherwise unreasonable

    On termination, any outstanding fees for work completed to that point remain payable.


    14. Governing law

    These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.


    15. Changes to these terms

    We may update these terms from time to time. Where changes materially affect your engagement, we will notify you in advance. Continued use of our services after notification constitutes acceptance of the updated terms.
